Assumptions of Risks:
Being a De Vor Dairy Farm And Creamery visitor or volunteer carries with it inherent risks that cannot be eliminated regardless of care taken to avoid injuries. Risks include, but are not limited to, scratches, bruises, sprains, broken bones, concussions, back and joint injuries, heart attacks, animal bites, kicks or head butts. I, the undersigned, my heirs and assigns assume all risks of loss or damage or injury, including paralysis or death, that may occur or be sustained while visiting or volunteering at any time, whether during a single visit or volunteer day, or during any event or activity sponsored by De Vor Dairy Farm And Creamery. I know, understand, and appreciate these and other risks that are inherent in visiting or being a volunteer with De Vor Dairy Farm And Creamery. I hereby assert that my presence and participation is voluntary and that I knowingly assume all such risks throughout the calendar year from which this form is signed.
Waive, Indemnification and Hold Harmless:
In consideration of being permitted to participate in any way at De Vor Dairy Farm And Creamery, I, for myself the undersigned, my heirs and assigns, do hereby release, waive, discharge, and covenant not to sue De Vor Dairy Farm And Creamery, its owners, employees, volunteers, and agents from liability from any and all claims including property loss, personal injury, accidents or illnesses (including death). I, my heirs and assigns, agree to indemnify and hold De Vor Dairy Farm And Creamery harmless from any and all claims, actions, suits, procedures, costs, expenses, damages and liabilities, including attorney’s fees brought as a result of my visit or by being a volunteer at De Vor Dairy Farm And Creamery, and to reimburse De Vor Dairy Farm And Creamery for such expenses incurred.
Acknowledgement of Understanding:
I, the undersigned, have read this De Vor Dairy Farm And Creamery visitor and volunteer liability waiver, fully understand its terms, and understand that I am giving up substantial rights, including my right to sue. I acknowledge that I am signing the agreement fully freely and voluntarily, and intend by my signature to be a complete and unconditional release of all liability to the greatest extent allowed by law. I, the undersigned, am 18 years of age or older and of sound mind.
Acknowledgement of Address Protection:
I, the undersigned, understand that the address is not public for safety reasons and to prevent dumping of animals. I will receive the address in order to attend as a visitor or volunteer, and I agree to keep private and not share the location of De Vor Dairy Farm And Creamery.
